The bill was amended to only lower the BPT from 7.6% to 7.5%. According to the fiscal note, the lowering of the BET would lower tax revenue by about $27.5 million and the lowering of the BPT would lower revenue by about $8.5 million. Cumulatively, they would lower tax revenues by about $36 million. By adopting the amendment, and not lowering the BET tax, we would only be lowering tax revenue by about $8 million. Many taxes were lowered in the previous year and although business tax collections are up, we are still determining the full impact of the Paycheck Protection Program (PPP) loans and COVID-19 stimulus on tax revenue. Therefore, keeping the tax reduction more moderate and not reducing other taxes is prudent at this time. Furthermore, when businesspeople consider moving their business to NH or keeping it in NH, one of the top line considerations is the Business Profits Tax (BPT). At a new rate of 7.5%, we will compare favorably with our neighbors in Massachusetts at 8% and Vermont at between 6 and 8.5%, where any business making over $25,000 is taxed at 8.5%. This very moderate tax reduction of 0.1% meets our original goal from several years ago to reduce from the then 8.5% rate to a 7.5% rate. Richard Ames", "committee": "Ways and Means", "text": "As amended, this bill reduces the Business Profits Tax rate from 7.6% to 7.5%. Overall, it is expected to lower the state's total business tax revenues by about $8 million annually. This change has not been requested or lobbied for by business owners. Testimony on the bill included no persuasive evidence demonstrating that this single decimal point rate reduction would have any noticeable impact on business decisions to move to or depart from the state. State revenues have been high this year, largely due to a huge temporary infusion of COVID-19-related federal funds, but even so, they have proved insufficient to meet local school and essential human service funding needs. Property tax rates have been forced up this year in many property-poor jurisdictions where state funding has failed to keep up with essential needs. Testimony on this bill and at the Ways and Means economic forum on March 4 provided no evidence-based support for this bill's proposed rate reduction, but made clear instead that equitable relief from high property tax rates is urgently needed to enhance the profitability of many struggling New Hampshire businesses as well as the quality and sufficiency of local public schools, worker housing, and infrastructure. Since 2014, rapid national and global growth, and more recently enormous federal stimulus funding for state businesses and consumers alike, have masked the state's revenue losses due to tax cuts given mostly to our largest businesses over the last six years. As the stimulus fades, and as new recession threatens, our revenue situation could become dire. Amend RSA 77-A:2 by inserting after paragraph II the following new paragraph:\n\nIII. For all taxable periods ending on or after December 31, 2023, a tax is imposed at the rate of 7.5 percent upon the taxable business profits of every business organization.\n\n189:2 Short Title. Section 4 of this act may be known as the \u201cProperty Tax Relief Act of 2022.\u201d\n\n189:3 Legislative Findings.\n\nI. New Hampshire\u2019s working families and small businesses are struggling with a 40-year high inflation rate that has had a devastating impact on the price of gasoline, home heating, and food resulting from policies adopted in Washington, D.C. since January 2021.\n\nII. Prior to January of 2021, the price of gasoline was approximately half of what it is today and now has steadily risen over the past 15 months.\n\nIII. Because of sound budget policies that controlled spending and made New Hampshire\u2019s business tax climate more competitive, state revenues are currently $252 million above budget projections, enabling the legislature to share the state\u2019s projected budget surplus with cities and towns in order to lower local property taxes.\n\n189:4 Local Property Tax Reduction. A one-time appropriation of state surplus funds is hereby granted to each political subdivision of the state in accordance with section 5 of this act. It is the intent of the legislature that this will result in a one-time reduction in local property taxes without increasing state or local baseline spending.\n\n189:5 Retirement System Costs; State Funding; Appropriation. For the state fiscal year ending June 30, 2023, the state shall pay to each political subdivision an amount equal to 7.5 percent of both the normal and accrued liability contributions of each political subdivision for benefits under the retirement system on account of its group II members and group I teacher members. The board of trustees of the retirement system shall certify the amount required for each such state payment based on actual payroll data from the fiscal year ending June 30, 2022, and the total amount of the state grants, to the treasurer. The governor is authorized to draw a warrant for the total sum of these one-time grants out of any money in the treasury not otherwise appropriated.\n\n189:6 Repeal. RSA 100-A:16, II(c-1) relative to employer contributions for fiscal year 2012, is repealed.\n\n189:7 Effective Date.\n\nI. Section 1 of this act shall take effect upon its passage.\n\nII.
