This bill was created after a study committee last year found that there was a serious concern that insurance companies were not always willing to pay for diagnostic scans and other procedures, which ensure that the embedded electronics and mechanical systems in modern vehicles that provide functions such as driver assistance and increase safe operation are returned to pre-loss functionality after a crash. The committee recognizes that mechanical and electronic components are integrated with sheet metal parts in today's vehicles, and repairers should be compensated for all necessary work to ensure a vehicle's proper and safe operation after an accident. We heard that independent body shops invested thousands of dollars into scanning equipment and training, because they are convinced of the importance of that testing for safety and correct operation. The use of after market or recycled parts was not a subject of the study committee or the original bill. A 2016 law based on the work of a previous study committee instituted a limited requirement for the use of original equipment manufacturer (OEM) parts on new, low mileage vehicles and indicated that like kind and quality parts could be used in other situations. At the request of the parts industry, this bill was amended to confirm that the 2016 law, RSA 407-D:3-a, defined the rules for parts use, regardless of OEM recommendations. Michael Costable", "committee": "Commerce and Consumer Affairs", "text": "The minority believes that this bill will unnecessarily increase premiums for automobile insurance by mandating reimbursement from insurance companies for all such recommendations pushed by original equipment manufacturer's (OEM) that any repair shop intends to follow. The minority is further opposed to turning recommended scans and calibrations into required procedures. The minority has no issue with shops getting reimbursed for proper repairs as this bill is intended to address, but as written goes well beyond that intent. It is important to understand that there are major differences between OEM \"recommendations\" versus \"requirements.\" Recommendations are not held to any standard and mostly include general indemnifying language. Required procedures are things that should or must be undertaken to ensure proper safety standards. The latter is already covered in the \"pre-loss condition\" standard whereby insurance companies must reimburse for all necessary and proper repairs or procedures to bring a vehicle back to it's pre-loss condition, including relevant calibrations. This standard is clear and well understood by interested parties. A large concern created by this bill is uncertainty, when OEM directives explicitly say a certain software package or type of calibration equipment must be used to perform proper calibration, coupled with that recommendation now becoming a required procedure. That can be interpreted as a prohibition on third party calibration systems. To date not one OEM recommends a third party system. We heard concerns from auto recyclers over prohibitions as well. After market parts are explicitly protected while recycled parts are not. For independent shops to offer calibration services in-house and follow OEM recommendations, they would be required to buy yearly software subscriptions, hardware and tools for each manufacturer. That equates to tens of thousands of dollars per year in software subscriptions alone. If the repair procedure or specification from an original equipment manufacturer includes a directive to conduct a scan, calibration, or diagnostic test of a vehicle's electronics systems before or after the commencement of repairs, such directive shall be considered as a required part of the repair procedure. The insurer shall reimburse the repairer if the repairer follows the directive. Notwithstanding any statements or recommendations contained in the original equipment manufacturer's repair procedures or specifications relative to the use of original equipment manufacturer parts, governance of the use of after market parts in the course of an insurer-funded repair shall be solely dictated by RSA 407-D:3-a. II. This section shall not apply to vehicle glass repair and emplacement services including, but not limited to, the calibration of Advanced Driver Assistance System (ADAS), when done by an automobile glass company. The company shall notify their customer after repair whether calibration has been performed. 407-D:3-c Paint and Materials Estimates. Amend RSA 417:4 by inserting after paragraph XXIII the following new paragraph:\n\nXXIV. Vehicle Repair Standards. No insurance company, agent, or adjuster shall knowingly fail to pay a claim to the claimant or repairer to the extent the claimant\u2019s vehicle is repaired in conformance with applicable manufacturer's procedures. Notwithstanding any statements or recommendations contained in the manufacturer's procedures relative to the use of parts, governance of the use of any and all parts, in the course of an insurer-funded repair shall be solely dictated by RSA 407-D:3-a and not by a manufacturer's recommendations or procedures.\n\n(a) If the vehicle is equipped with an advanced driver assistance system, an automotive glass company, repair facility, or insurer informing, approving, or conducting glass repair or replacement shall:\n\n(1) Prior to approving or performing glass repair or replacement, inform the consumer if a calibration of that system is required and if such calibration will be performed;\n\n(2) If performing such calibration, meet or exceed the manufacturer's procedures or specifications; and\n\n(3) If a calibration was not performed or not completed successfully, inform the consumer that the vehicle should be taken to a vehicle manufacturer\u2019s certified dealership, a qualified automobile glass company, repair facility, or other qualified repairer capable of performing the calibration of an advanced driver assistance system that meets or exceeds the manufacturer's procedures or specifications.\n\n(b) If the vehicle is equipped with an advanced driver assistance system, an automotive glass company, repair facility, or insurer informing, approving, or conducting a scan or calibration for motor vehicle repairs or replacement:\n\n(1) Shall not be limited to tooling or equipment dictated or recommended by the manufacturer's procedures or specifications.\n\n(2) Shall calibrate an advanced driver assistance system meeting or exceeding the manufacturer's procedures or specifications.\n\n(c) If a repairer does not accept a paint and materials estimate proposed by an insurer, the insurer shall reimburse the repairer based on any third-party guidelines generally accepted by automobile repair shops and insurers, and used by the repairer.\n\n(d) In this paragraph, \u201cmanufacturer's procedures\u201d means a manufacturer's written procedures, specifications, tolerances, and other technical requirements or instructions with respect to repairs.\n\n2 Effective Date.
