The minority has objected to the bill, stating that changes to absentee ballot provisions must be adopted only by amending the New Hampshire constitution. New Hampshire statutes, however, already extend absentee voting to persons who will presumably be located within their voting districts but are unable to leave their homes due to religious obligations, an excuse not enumerated in Part 1, Art. 11 of the New Hampshire Constitution. The minority also expressed concern that the bill does not address the security of these absentee ballots. Since the current absentee ballot procedures are secure and there is nothing in the bill that would require additional security, there is no need to include new measures in this bill. The majority of the committee believes this statutory change respects the New Hampshire Constitution and that the existing security procedures are sufficient."}, {"side": "Minority", "author": "Rep. While the minority agrees in concept with the underlying principles of increasing voter ballot access, there are issues with this bill. First and foremost, the reasons for absentee voting are outlined in the NH Constitution under Part 1, Article 11. This bill seeks to change what is outlined in the constitution, by way of a bill, which makes the change unconstitutional on its face. Additionally, if you could overcome the unconstitutional issues of this bill, when considering voter access, you must keep in mind the delicate balance and tension between increasing the ease of voting, with the need for election integrity. This bill is all about the ease of voting side with no compensating controls for the election integrity side of that delicate balance. As we have seen in this past 2018 election cycle in other states, abuse of the absentee ballot system has caused grief, and fraud by way of `ballot harvesting,' no voter identification, or inappropriately registering voters. The NH Secretary of State agrees that this change to absentee ballot access will increase the risk in NH for these types of abuse. The minority also believes that changing NH to a `no excuse' absentee ballot state, without compensating controls, the integrity of our elections will be put at risk, which will further undermine citizens' confidence in the election process and government."}], "source": "House Calendar 14, 2019", "date": "2019-03-07", "dated": "signed", "cite": "HC 14", "cite_url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=calendars%5C2019%5CNo%2014%20March%2001%202019.pdf"}], "docket_reports": [{"date": "2019-05-23", "dated": "signed", "body": "S", "committee": "Election Law and Municipal Affairs", "side": "", "recommendation": "OUGHT TO PASS", "vote_yeas": null, "vote_nays": null, "amendment": "", "new_title": false, "cite": "SC 23", "cite_url": "https://gc.nh.gov/senate/calendars_journals/viewer.aspx?fileName=Calendars%5C2019%5CNo%2023%20May%2016%202019.pdf"}, {"date": "2019-05-30", "dated": "signed", "body": "S", "committee": "Election Law and Municipal Affairs", "side": "", "recommendation": "OUGHT TO PASS", "vote_yeas": null, "vote_nays": null, "amendment": "", "new_title": false, "cite": "SC 24", "cite_url": "https://gc.nh.gov/senate/calendars_journals/viewer.aspx?fileName=Calendars%5C2019%5CNo%2024%20May%2023%202019.pdf"}], "report_actions": [], "veto_message": {"bill": "HB611", "text": ["By the authority vested in me, pursuant to part II, Article 44 of the New Hampshire Constitution, on September 6th, 2019, I have vetoed House Bill 611, allowing voters to vote by absentee ballot.", "Part 1, Article 11 of the New Hampshire Constitution makes clear that absentee voting shall be permitted in cases of absence or physical disability. However, the Department of State assumes that for every 100,000 additional absentee ballots cast, at a cost of $0.25 per ballot, the extra cost would be $25,000 per election. The Department indicates municipalities would realize the bulk of increased postage and handling costs and the labor involved with processing such ballots. Extensive training of local election officials will be required. Complaints of improper voting may also increase, leading to additional investigatory costs. The total cost of implementation is indeterminable.\n\nThe New Hampshire Municipal Association states the Secretary of State prepares absentee ballots for state elections and municipal clerks prepare absentee ballots for municipal elections. Preparation of additional absentee ballots incurs additional costs, which may be offset by reduced expenses for ballot preparation at the polling place. Municipal clerks are responsible for mailing all absentee ballots for both state and local elections, so the additional envelopes and postage costs may be significant but are unknown. Absentee ballots are processed by the clerk before election day and by the moderator on election day, and additional labor will be required, which may involve increased costs. There may be a reduction in the number of election officials needed at the polling place but that is not projected to offset the increased labor needed for the processing of absentee ballots. There is no way to predict the number of additional absentee voters or associated costs, therefore the effect on municipal expenditures cannot be estimated. There should be no impact on municipal revenues.\n\nThis bill contains penalties that may have an impact on the New Hampshire judicial and correctional systems. There is no method to determine how many charges would be brought as a result of the changes contained in this bill to determine the fiscal impact on expenditures. However, the entities impacted have provided the potential costs associated with these penalties below.\n\nJudicial Branch\n\nFY 2020\n\nFY 2021\n\nClass B Misdemeanor\n\n$53\n\n$54\n\nClass A Misdemeanor\n\n$76\n\n$77\n\nSimple Criminal Case\n\n$296\n\n$301\n\nRoutine Criminal Felony Case\n\n$481\n\n$486\n\nAppeals\n\nVaries\n\nVaries\n\nIt should be noted that average case cost estimates for FY 2020 and FY 2021 are based on data that is more than ten years old and does not reflect changes to the courts over that same period of time or the impact these changes may have on processing the various case types.
