The New Hampshire Municipal Association, the New Hampshire Tax Collector's Association, and the New Hampshire Department of Safety are all opposed to this bill. The bill has structural issues; it requires the DMV to make changes to their operation at a cost of $500,000 and is in conflict with three other RSA's. This bill has been submitted multiple times before and failed to pass. At this point it's a stew which has spoiled due to the many variations, changes and unsubstantiated consequences in the current language."}], "source": "House Calendar 11, 2017", "date": "2017-02-15", "dated": "signed", "cite": "HC 11", "cite_url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=calendars%5C2017%5CNo%2011%20February%2010%202017.pdf"}, {"bill": "HB579", "title": "relative to registration of semi-trailers", "majority_recommendation": "INEXPEDIENT TO LEGISLATE", "minority_recommendation": null, "reports": [{"side": "Committee", "author": "Rep. Firstly, unlike the boat registration fee which was used as a template, where both non-residents and residents are treated equally, this legislation creates a disadvantage to New Hampshire residents. Secondly, the bill, if passed, would permit the registration of semi-trailers in New Hampshire to violate the motor vehicle registration laws of other states. The bill, as written, is a direct violation of RSA 261:40. Unfortunately, the fine for such a violation is merely $100 and not a deterrent. In addition, the violation of the law is difficult to enforce which casts a blind eye on the registration of the owners of semi-trailers who flock to Maine to obtain a more lucrative deal covering a 12-year registration period. The upfront cost of $500,000 to implement the program is not insignificant. No data was presented to demonstrate how the revenues would be generated. The intent of the sponsors was to increase revenues to the state by competing with our neighboring state of Maine. The passage of the bill would not entice residents and non-residents to return to New Hampshire. Also, this legislation would result in a loss of motor vehicle revenues to our cities and towns and would directly increase the property tax burden of our citizens. Far too many unknowns and unintended consequences are associated with this legislation."}], "source": "House Calendar 11, 2018", "date": "2017-02-15", "dated": "signed", "cite": "HC 11", "cite_url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=calendars%5C2018%5CNo%2011%20March%2016%202018.pdf"}, {"bill": "HB579", "title": "relative to registration of semi-trailers", "majority_recommendation": "OUGHT TO PASS WITH AMENDMENT", "minority_recommendation": "INEXPEDIENT TO LEGISLATE", "reports": [{"side": "Majority", "author": "Rep. Third party agents would be authorized to process such registrations and remit fees to the state. Discounts would be offered for multi-year registrations. Opponents expressed concern NH based companies can avoid municipal taxes by registering in Maine. An amendment was adopted to ensure municipal taxes and fees would be collected, remitted, and discounts would be limited to 12 years. Supporters note that NH companies currently can acquire Maine registrations to avoid NH taxes and fees by simply forming a Maine entity to own the trailers; an option which has been available for over two decades. Finally, this is a second committee bill to look at only the revenue impact, not the policy decision previously made by the Transportation Committee and the House."}, {"side": "Minority", "author": "Rep. Suzanne Gottling", "committee": "Ways and Means", "text": "This bill creates a new bureaucracy intended to bring revenues to New Hampshire state government by opening a revenue stream not currently available at the expense of residents and local governments. The bill mimics Maine's process, which allows registration of semi-trailers not garaged in Maine. Multi-year registrations of up to 12 years are offered at a discount price. NH registrations would be pursued by private agents trained and supervised by the Department of Safety. The Department of Safety (Motor Vehicles), the NH City and Town Clerks Association, and the New Hampshire Municipal Association strongly oppose this legislation. This bill places New Hampshire residents as well as cities and towns at a monetary disadvantage. The bill penalizes NH citizens who must pay both the state and the town portions of registration fees while out-of-state entities need only pay the state portion. The City of Manchester calls this \"reverse residency.\" The New Hampshire City and Town Clerk's Association asserts the bill encourages a local business to register a shell company out of state in order to evade the town fee, substantially reducing revenue for our cities and towns. The Department of Motor Vehicles opposes the bill, as it requires them to set up a system and then manage it with a $500,000 cost for the initial set-up and about $200,000 in subsequent years, with no guarantee that revenues to cover costs will be generated. In fact, given the state of the market, it is unlikely NH will attract enough business to cover the costs that will be incurred by the Department. A final concern is the state of the market. Maine has been registering out of state semi-trailers for at least 25 years and has only acquired 111,000 of the eleven million registered trailers in the country, including trailers owned by Maine companies, Maine's total share of the market is only 1%. Federal data shows other states already have the lion's share of the market. If Maine has been unable to lure more registrations and NH is mimicking Maine, there is no reason to expect NH will be successful. Owners of semi-trailers will have no incentive to change their registrations, since Maine has exempted these trailers from their sales tax. By registering trailers for up to twelve years, New Hampshire will be locking itself into this costly revenue scheme and bureaucratic expansion for at least that long. The state should not spend taxpayer money creating a costly new bureaucracy. Scrambling for these revenue crumbs is likely to penalize our own citizens, rob our cities and towns of important revenue, and create a budget deficit at the Department of Safety. If Maine has been unable to lure more registrations and NH is mimicking Maine, there is no reason to expect NH will be successful. Owners of semi-trailers will have no incentive to change their registrations, since Maine has exempted these trailers from their sales tax. By registering trailers for up to twelve years, New Hampshire will be locking itself into this costly revenue scheme and bureaucratic expansion for at least that long. The state should not spend taxpayer money creating a costly new bureaucracy. Scrambling for these revenue crumbs is likely to penalize our own citizens, rob our cities and towns of important revenue, and create a budget deficit at the Department of Safety. This bill may result in an increase of semi-trailer registrations from nonresidents, but the bill also offers discounted rates for multi-year registrations. It is unknown what the net impact of these provisions will be. Furthermore, pursuant to RSA 235:23, not less than 12 percent of the total motor vehicle fee revenue collected in the previous year is distributed to municipalities by the Department of Transportation as highway block grants. Therefore, this bill would have an indeterminable impact on highway fund expenditures and local revenues.\n\nThe Division of Motor Vehicles (DMV) currently procures registration decals for up to three years in advance. Under this bill, it would need to purchase registration decals for an additional nine years in advance, at an estimated cost of $216,000.\n\nTo make the necessary system changes, DMV estimates one-time programming costs of $151,800.\n\nTo comply with the requirements in this bill (agent training, auditing, administration, etc...), DMV estimates it would need three new clerk IV positions at a total cost of $177,000 in FY 2019, $171,000 in FY 2020, $180,000 in FY 2021, and $186,000 in FY 2022.\n\nProviding equipment to online agents is estimated to cost $1,500 per set-up.\n\nIn addition to the aforementioned impact to highway block grants, local revenue will be impacted by an indeterminable amount to the extent this bill will affect municipal permit fees for semi-trailers. Local expenditures may also increase to make any necessary system programming changes.\n\nAGENCIES CONTACTED:\n\nDepartment of Safety", "in_text": [], "chars": 15445}, "nver": 0, "namd": 0, "rsa": {"RSA 261:45": "/laws/261#s45", "RSA 261:40": "/laws/261#s40", "RSA 100-A:57": "/laws/100-a#s57", "RSA 485-F:4": "/laws/485-f#s4", "RSA 541-A:2": "/laws/541-a#s2", "RSA 169-C:39-k": "/laws/169-c#s39-k", "RSA 318-B:43": "/laws/318-b#s43", "RSA 356-B:70": "/laws/356-b#s70", "RSA 125-Q": "/laws/125-q", "RSA 485-F:5": "/laws/485-f#s5", "RSA 21-J:14-a": "/laws/21-j#s14-a", "RSA 99-E:1": "/laws/99-e#s1", "RSA 19-K:1": "/laws/19-k#s1", "RSA 126-A:73": "/laws/126-a#s73", "RSA 14:30-a": "/laws/14#s30-a", "RSA 238-A:2": "/laws/238-a#s2", "RSA 228:107": "/laws/228#s107", "RSA 651-E:2": "/laws/651-e#s2", "RSA 119:3-a": "/laws/119#s3-a", "RSA 198:15-z": "/laws/198#s15-z", "RSA 126-T": "/laws/126-t", "RSA 77-A:23": "/laws/77-a#s23", "RSA 41:6": "/laws/41#s6", "RSA 31:22": "/laws/31#s22", "RSA 31:23": "/laws/31#s23", "RSA 53-B:8-a": "/laws/53-b#s8-a", "RSA 261:74-t": "/laws/261", "RSA 41:29": "/laws/41#s29", "RSA 261:62": "/laws/261#s62", "RSA 261:141": "/laws/261#s141", "RSA 261": "/laws/261", "RSA 261:46": "/laws/261#s46", "RSA 261:74-w": "/laws/261", "RSA 541-A": "/laws/541-a", "RSA 261:153": "/laws/261#s153", "RSA 266:1-b": "/laws/266#s1-b", "RSA 259:37-a": "/laws/259#s37-a", "RSA 259:98": "/laws/259#s98", "RSA 235:23": "/laws/235#s23"}, "amends": {"RSA 41:6": "/laws/41#s6", "RSA 261:62": "/laws/261#s62", "RSA 261": "/laws/261", "RSA 261:141": "/laws/261#s141", "RSA 261:46": "/laws/261#s46", "RSA 261:153": "/laws/261#s153", "RSA 266:1-b": "/laws/266#s1-b"}, "related": [{"g": 0, "o": "2017-2018/HB1614", "n": "HB 1614", "t": "relative to the international registration plan and relative to registration of semi-trailers.", "y": 2018, "c": "Died", "s": "Its language was offered as amendment 2018-1609s to {b}; the Senate adopted it."}, {"g": 2, "o": "2017-2018/HB1614", "n": "HB 1614", "t": "relative to the international registration plan and relative to registration of semi-trailers.", "y": 2018, "c": "Died", "s": "This term's {b} has much the same text."}]}
