Gasoline purchases serve as an imperfect proxy for wear and tear on the roads and bridges, however, because new vehicles have been trending more efficient and some vehicles have abandoned gas as a fuel for propulsion entirely. This creates a quandary on how to maintain roads and bridges with declining state gas tax revenues. This bill corrects that problem by establishing a road usage fee (RUF), due at the time of annual registration, for all motor vehicles with a US Environmental Protection Agency (EPA) fuel economy rating of more than 20 miles per gallon (MPG). All fee revenue collected, less a $1 registration agent fee and highway block grant payments to municipalities pursuant to RSA 235:23, I, would be credited to a newly established separate account within the highway fund that would be non-lapsing and continually appropriated to the Department of Transportation for the maintenance, design, rehabilitation, and construction of state roads and bridges, including right-of-way acquisition. In addition, this bill makes a general fund appropriation of $330,000 in FY 2018 to the Department of Safety for the purpose of implementation. The RUF shall be based on a vehicle that travels 10,000 miles per year and averages 20 MPG. Such a base vehicle would pay $111 per year in road toll (gasoline tax). The RUF for such base vehicle is $0. The RUF for all other vehicles shall be $111 minus the New Hampshire road toll paid per year based on 10,000 miles of travel. The RUF shall not apply to motorcycles as defined in RSA 259:63, mopeds as defined in RSA 259:57, OHRVs as defined in RSA 259:69, and motor vehicles that are model year 1983 or older. The Department of Safety, in conjunction with the Department of Transportation, shall develop and maintain a system which links the United States Environmental Protection Agency's fuel economy data system with the Department of Safety's vehicle identification number (VIN) data system, allowing registration agents to collect the road usage fee established in amounts based on fuel economy ranges at 10,000 miles per year. The amendment simplifies the administration by reducing the number of MPG ranges by using 10 MPG ranges instead of 5 MPG ranges. It is estimated that 43% of the 1,398,718 registered vehicles would pay no RUF if implemented today. High efficiency gas and hybrid vehicles with a fuel economy range of 40-50 MPG would pay a RUF of $62.21 (an estimated 10,862 vehicles). A vehicle that uses no gasoline (an estimated 5,019 vehicles) would pay a RUF of $111, the same as a vehicle rated at 20 MPG or less that pays $20 or more in gas tax. Federal CAFE Standards have brought ever-increasing miles per gallon to more and more of the vehicles on our roads. We have increased total vehicles, and vehicle miles, but that has not increased the receipts of the \"road toll\" or gas tax. Some suggestions have been to put mileage trackers on every vehicle and charge accordingly. That was seen as very intrusive on one's privacy as well as very expensive. The method that the bill employs is to place vehicles in different mpg categories. Motorcycles are exempt as well as vehicles achieving less than 20 mpg or manufactured in 1983 and prior. This of course exempts trucks. Trucks may put more wear and tear on the roads, but it was decided that between the higher registration costs and the higher fuel consumption, they already are paying a large share. As to the other categories, they go up by 10 mpg from 20 mpg to greater than 50 mpg; then to no gasoline consumption at all. Since the vehicles with better mpg in comparison with 20 mpg or less, are achieving considerable savings on the gas tax; this bill would tax 9% of the calculated savings based on 10,000 miles per year, and the mpg given by the manufacturer in the VIN. Typically for vehicles in the 20-30 mpg this would result in a charge of $23.94 collected on yearly registration payment and designated as \"road usage fee.\" Payments would go as high as $111 for vehicles that used no gas. It is estimated that this fee would bring 21 million to the Highway Fund. We have had several years of using Turnpike surplus to balance the Highway Fund by selling 7 miles of highway and a bridge from DoT to Turnpike. After exhausting those funds, we last transferred General Funds to the Highway Fund. We had an unexpected General Fund surplus in the present budget, but that is unlikely in the next one. The bill is accepted as a fair way to assign the cost of maintaining our roads and bridges across the users and will assure the future funding, as we can expect ever-increasing mpg in our vehicles as well as alternate untaxed fuels. The concept was well accepted by the Ways and Means Committee and the NH House. It came to Finance, where we amended the bill by changing the funding from General Funds for the $330,000 IT investment to Highway Funds, and to making the new revenue go to the Highway Fund rather than a new designated fund. Amend RSA 260 by inserting after section 32-c the following new section:\n\n260:32-d Road Usage Fee.\n\nI. Except as provided by paragraph II, the owner of each New Hampshire motor vehicle which has an equivalent miles per gallon (MPG) more than 20 MPG shall be required to pay a road usage fee at the time of registration of the vehicle, other than temporary registration, with a registration agent. The road usage fee shall be based on a vehicle that travels 10,000 miles per year and averages 20 MPG. Such a base vehicle would use 500 gallons of fuel and pay $111 per year in road toll. The road usage fee for such base vehicle is $0. The road usage fee for all other vehicles shall be $111 minus the New Hampshire road toll paid per year based on 10,000 miles of travel.\n\nII. The road usage fee shall not apply to motorcycles as defined in RSA 259:63, mopeds as defined in RSA 259:57, off highway recreational vehicles as defined in RSA 259:69, and motor vehicles that are model year 1983 or older.\n\nIII. The department of safety, in conjunction with the department of transportation, shall develop and maintain a system which links the United States Environmental Protection Agency's MPG data system with the department of safety's vehicle identification number (VIN) data system, allowing registration agents to collect the road usage fee established in amounts based on the following MPG ranges:\n\nMPG range at 10,000 miles per year\n\n20 or less\n\ngreater than 20 to 30\n\ngreater than 30 to 40\n\ngreater than 40 to 50\n\ngreater than 50\n\nno gasoline\n\nIV. The registration agent may retain $1 of each road usage fee collected in compensation for the administrative costs of collecting the fee. The remainder of the fees shall be remitted to the state treasurer for deposit, net of any \"Apportionment A\" allocated to the local highway aid fund for distribution under RSA 235:23, I, in the highway fund.\n\n2 Implementation of Road Usage Fee. Before April 1, 2019, the commissioner of safety, in conjunction with the commissioner of transportation, shall develop the linked data system required under RSA 260:32-d as inserted by section 1 of this act and adopt rules pursuant to RSA 541-A to establish road usage fees based on the requirements and mileage per gallon ranges (MPG) established in RSA 260:32-d, I and III.\n\n3 Appropriation; Department of Safety. The sum of $330,000 is hereby appropriated to the department of safety for the biennium ending June 30, 2019, for the purpose of implementing the provisions of this act. The appropriation shall be a charge against the highway fund and is in addition to any other funds appropriated to the department of safety.\n\n4 Effective Date.\n\nI. The road usage fee will be calculated as $111 minus the estimated road toll paid per year based on 10,000 miles of travel for each vehicle. The base amount of $111 based on a 20 MPG vehicle that travels 10,000 miles ($0.222 road toll X 500 gallons). The Department of Safety states available data is insufficient to make an estimate on this bill\u2019s revenue impact at this time.\n\nThis bill allows for the retention of $1 per each road usage fee collected by the registration agent, which will increase local revenues by an indeterminable amount depending on the number of fees processed. Also, pursuant to RSA 235:23 (\u201cApportionment A\u201d), 12 percent of total road toll revenue and motor vehicle fees are distributed to cities and towns pursuant to the specified formula in the following year, which will increase both state expenditures and local revenues by an indeterminable amount depending on total road usage fee revenue. Revenue collected, net of the registration agent fee and \u201cApportionment A\u201d is to be credited to a separate account in the state highway fund, continually appropriated to the Department of Transportation for the purpose of maintenance, design, rehabilitation, and construction of state roads and bridges.\n\nThis bill includes a general fund appropriation of $330,000 in FY 2018 for the Department of Safety for the purpose of implementing the provisions of this act. The Department estimates this would be sufficient to cover start-up cost, mostly related to system modifications and testing, required for the implementation of this bill. As currently written, the appropriation in FY 2018 would lapse June 30, 2018 and not be available to the Department for expenditure in FY 2019.
