This law was passed by Congress in 2005. The concept was taken from the 911 Commission report. It stated the federal government should set standards for the issuance of birth certificates and sources of identification such as drivers' licenses. It was feared by many that this would turn into a national identification card data base. That fear has been averted. Developing a NH compliant drivers' license does not create a national ID card, a federal data base of driver license information or new federal access to state data. This bill will allow NH citizens to voluntarily obtain a real ID compliant license. This bill is completely opt-in. The deadlines have been set by Homeland Security. Many federal buildings are not now accessible with a NH license. Provisions governing the boarding of aircraft will take effect January 2018. If we do not act in a responsible manner hundreds of thousands of our citizens will be greatly affected. If we do not act we will be forcing our citizens to obtain a passport causing some families great financial difficulty. In NH if you wish to have your picture and Social Security number removed from the Department of Safety data base after you receive your license you may. To opt-in for a Real ID license you must agree to leave those two items retained in the NH system. If you choose not to have a Real ID license you will still be able to have those two items removed. Your license will be marked non compliant for federal purposes if you do not have a Real ID license. Though some feel that we should continue to refuse to participate in Real ID, we were elected to govern in the best interests of the citizens of the State of NH. Preventing our constituents from having the option of obtaining a Real ID license is unfair and unnecessary. This bill is completely voluntary. No one is being forced or asked to obtain a Real ID license. We are only giving them the ability to make an informed decision on participating or not participating in Real ID. The amendment sends a strong statement of dissatisfaction with Real ID. The commissioner shall, upon payment of the required fee, issue to every applicant a driver's license subject to such conditions as the commissioner may deem expedient and in such form as the commissioner may prescribe. Licenses issued to persons under the age of 21 shall be designed so that their horizontal and vertical axes are opposite the horizontal and vertical axes of licenses issued to other persons, and said licenses shall prominently display the date on which the licensee shall attain the age of 21 years. Consistent with RSA 263:14, the youth operator license shall expire on the 21st anniversary of the applicant's date of birth, at which time the applicant shall be issued a traditional license. The license shall bear thereon a distinguishing number assigned to the licensee and an instant full-face color photograph, image, or likeness of the licensee. There shall also be provided a space wherein the licensee may indicate his or her honorable veteran's status for purposes of identification for receiving benefits and services under New Hampshire law if the licensee so desires. The license shall bear a special designation or symbol indicating honorable veteran's status for licensees who indicate such veteran status. The driver\u2019s license card shall bear an approved security marking indicating that it was not issued in compliance with Public Law 109-13 and is therefore not acceptable for federal identification purposes.\n\nII. Drivers' licenses compliant with Public Law 109-13 issued pursuant to RSA 263:14-b shall bear the name, address, date of birth, veteran's status for the purposes of identification for receiving benefits and services under New Hampshire law (optional), organ donor status (optional), picture, and signature of the applicant. The driver\u2019s license card shall bear an approved security marking indicating that it was issued in compliance with Public Law 109-13 and is therefore acceptable for federal identification purposes.\n\nIII. Enhanced drivers' licenses issued pursuant to RSA 263:14-c shall bear the name, address, date of birth, veteran's status for the purposes of identification for receiving benefits and services under New Hampshire law (optional), organ donor status (optional), picture, and signature of the applicant. Notwithstanding any law to the contrary, the department is authorized to participate in the National Driver Register (NDR) and Problem Driver Pointer System (PDPS), to achieve the state's compliance with the provisions of the National Driver Register Act of 1982, as amended, and its implementing regulations, and to facilitate the state's compliance with the provisions of the driver license compact authorized by RSA 263:77.\n\nIII. Notwithstanding any law to the contrary, the department is authorized to participate in the Commercial Driver's License Information System (CDLIS), to achieve the state's compliance with the provisions of the Federal Commercial Motor Vehicle Safety Act 1986, as amended, and its implementing regulations.\n\nIV. Notwithstanding any law to the contrary, the department is authorized to participate in the National Law Enforcement Telecommunications System (NLETS).\n\nV. Notwithstanding any law to the contrary, the department is authorized to participate in the National Motor Vehicle Title Information System (NMVTIS), to achieve the state's compliance with the provisions of the Federal Anti Car Theft Act of 1992, as amended, and its implementing regulations.\n\nVI. Notwithstanding any law to the contrary, the department is authorized to participate in a pointer based state-to-state driver verification system with information from applicants for drivers' licenses and identification cards pursuant to RSA 263:14-b, RSA 263:14-c, RSA 260:21-a, and RSA 260:21-b.\n\n71:16 Records and Certification. Amend RSA 260:14, III to read as follows:\n\nIII. Motor vehicle records may be made available pursuant to a court order or in response to a request from a state, a political subdivision of a state, the federal government, or a law enforcement agency for use in official business.
