New Hampshire is a work at-will state, meaning you can be hired or fired for any or no reason. As such, an employer could simply state that an applicant is not a good fit for the company, or choose to give no reason at all for rejecting an applicant, and that would be perfectly legal. Regardless of any legal reason for rejection, if there was one, this bill opens the door to allow rejected applicants to make claims of discrimination against an employer if the applicant had been a victim of domestic violence, harassment, sexual assault, or stalking. This in turn results in employers having to spend time and money to defend themselves against frivolous allegations. Steve Vaillancourt", "committee": "Criminal Justice and Public Safety", "text": "The minority amendment, in recognition of a potential problem in regard to discrimination against victims of domestic violence in the workplace, would retain the study portion of this bill. However note the word \"potential\" problem. The committee heard absolutely no evidence that such a problem exists, and until evidence is produced in the form of a study committee, the minority is convinced this bill is simply a solution looking for a problem that does not exist. When we passed Joshua's law a few weeks ago, we set in motion an ability to discover instances of domestic violence. In fact, no one would deny that domestic violence is real and must be dealt with. However, we should not mix the very real concern over domestic violence with an imagined concern that people are discriminated against at the work place. When asked to provide evidence, any evidence at all, one of the bill's supporters could only site a fear by a 26-year old woman he had spoken with. If we begin to legislate out of concern for \"fears,\" there would be no end of bills which might come forward. Many such bills would do no good but would also do no harm. This bill, however, has the potential for harm in two very important instances. Should this pass prior to any appropriate study, we could be encouraging the filing of any number of lawsuits. For example, let's say a person is fired for inability to perform on the job. That person could simply claim he or she has been the victim of domestic violence and was fired for that reason. A study committee could explore ways of tightening up language so this would not happen. Even more significantly, this bill, as an unintended consequence, could actually lead to a dramatic and horrifying increase of workplace violence. We hear of all too many episodes of a disgruntled employee opening fire at random in the workplace and killing innocent people. Employers have become cognizant of such episodes and are taking precautions. However, were this bill to pass, employers, out of fear of being sued if they take such precautions, might slack off leading to a true tragedy. One member of the committee suggested it would be a crime not to vote for this bill. The minority is convinced that the true crime would be if a mass killing were to occur at a workplace because an employer was more concerned about the legal ramifications of this bill and relaxed security at the establishment. Until we get some data as to whether a problem really exists, it would be irresponsible for us to jeopardize everyone on the workplace in search of a solution to a problem that may not exist. The minority sadly notes that some in favor of this bill choose to demagogue it by saying that \"you're either in favor of the victim or of the perpetrator.\" That may be a good talking point for some campaign, but it's an irresponsible way to legislate. Nothing in this bill would allow a potential victim to sue the employer to be made whole. If proponents of this bill were really concerned about potential victims, they would have included such a provision. Amend RSA 275 by inserting after section 70 the following new subdivision:\n\nProtection from Domestic Violence\n\n275:71 Prohibited Conduct by Employer. It is an unlawful employment practice for an employer to:\n\nI. Refuse to hire an otherwise qualified individual because the individual is a victim of domestic violence, harassment, sexual assault, or stalking.\n\nII. Discharge, threaten to discharge, demote, suspend, or in any manner discriminate or retaliate against an individual with regard to promotion, compensation or other terms, conditions, or privileges of employment because the individual is a victim of domestic violence, harassment, sexual assault, or stalking.\n\n275:72 Penalty. Any employer who violates this subdivision shall be subject to a civil penalty, to be imposed by the labor commissioner in accordance with the procedures established in RSA 273:11-a. An employer aggrieved by the commissioner\u2019s assessment of such penalty may appeal in accordance with RSA 273:11-c.\n\n208:2 Committee Established. There is established a committee to study the protection of employees from domestic violence.\n\nI.
