McMahon", "committee": "Health, Human Services and Elderly Affairs", "text": "This measure seeks to provide the financial means to end the Developmental Disability (DD) Wait List by amending SB 138 to include the money needed to end the Wait List as we know it. It does this by providing the funding necessary to meet the 90 day maximum wait for services goal as originally set forth in the Renewing the Vision Plan of 2001. The DD Wait List has for over two decades been the gate-keeper for support services promised to New Hampshire families after the closing of the Laconia State School in 1990. The Legislature since then has consistently under-funded the waiting list and as a result, access to programs and services for those families with developmentally disabled young adults have suffered, greatly. The untold strain on individuals and their extended families is one that is met with a resiliency and resolve that has made New Hampshire proud and a model for the rest of the country. These families have committed to meet the ever changing needs of their disabled family members in the face of financial and personal hardship while saving the State of New Hampshire virtually millions of dollars. They have done their part, it is now time for us to do ours. Over the past four years, the DD Wait List Oversight Committee resolved, together, to work with one bipartisan common goal, the elimination of the Wait List by offering a viable plan as a direct result of these efforts. Yet the bill was retained in committee with the claim that Area Agencies could not meet the service challenge over two years which full funding provided. Then, SB 138 suddenly appeared, with additional issues, but not ending the wait list as quickly as would be hoped for. In effect, it is Renewing the Vision once again, providing the false promise of helping some families on the wait list while not providing the funding required for ALL families. This is not right. Subsequently, the claim that the AA's cannot meet their obligations has been totally refuted through a signed document by all Area Agency heads. Working with the department and with the support of Division II House Finance, we are now $2.3 million away from full funding and the end of this abomination known as the waiting list. Let us prioritize and join together in support of this amendment to fully support the section in SB 138 for wait list funding and meet the goal of the 90 day maximum wait over the upcoming two year biennium. The general court finds that:\n\nI.\nUndue delays in providing services to eligible persons with\ndevelopmental disabilities and acquired brain disorders are contrary to the\nwelfare of such individuals, their families, and the citizens of New Hampshire. Undue delays frequently cause individuals to\nlose skills acquired as part of their education, places them at risk of other\nphysical and emotional harm and unnecessary and costly institutionalization,\ncreates untold stress on families, temporarily or permanently hinders such\nindividuals\u2019 ability to become as independent and productive as possible, and\nis otherwise contrary to the purposes of this chapter.\n\nII. It is essential that sufficient\nfunding be provided to the department of health and human services and the area\nagencies to ensure that persons with developmental\ndisabilities and acquired brain disorders who are eligible to receive services\nin the state\u2019s developmental services system receive initial, modified, or\nadditional necessary services without undue delay.\n\nIII.\nIt is equally essential that supports and services afforded eligible\nindividuals with developmental disabilities and acquired brain disorders meet\ntheir individual existing and changing needs, and to that end services\nprovided, contracted, or otherwise arranged by area agencies be of sufficient\nquality and amount and offer a sufficient range of choices to meet the needs of\neligible individuals and assure that the purposes and requirements of this\nchapter are met. A principal element in\nthe provision of quality services is the recruitment and retention of a\nsufficient number of qualified personnel at all levels, which in turn requires\nthat personnel be well trained and reasonably compensated.\n\nIV. Comprehensively addressing access and\ndelay issues as well as the related service quality and cost effectiveness\nissues provides an excellent guidepost for necessary improvements to the\ndevelopmental services system in keeping with the findings and recommendations\nof the Governor\u2019s Commission to Study Area Agencies and Their Role in Providing\nService to New Hampshire\u2019s November 2005 report, hereinafter\nthe governor\u2019s commission report.\n\nV.\nCurrent capacity of the developmental service system to immediately take\nall eligible individuals off the waiting list and provide a full complement of\nservices is limited. It is therefore\nnecessary to phase in a plan which will address the waitlist backlog of undue\ndelays and at the same time prevent a new backlog from developing.\n\n363:2 Limits on Waiting Lists; Full\nFunding. RSA 171-A:1-a is repealed and\nreenacted to read as follows:\n\n171-A:1- a Full Funding of Services Budget;\nLimits of Waiting Lists.\n\nI.\nThe department of health and human services and area agencies shall\nprovide services to eligible persons under this chapter and persons eligible\nfor the brain injury program under RSA 137-K in a timely manner. The department and area agencies shall\nprovide services in such a manner that:\n\n(a) For persons\nin school and already eligible for services from the area agencies, funds shall\nbe allocated to them 90 days prior to their graduating or exiting the school\nsystem or earlier so that any new or modified services needed are available and\nprovided upon such school graduation or exit.\n\n(b) For newly found eligible adults, the\nperiod between the time of completion of an individual service agreement\npursuant to RSA 171-A:12 and the allocation by the department of the funds\nneeded to carry out the services required by the agreement shall not exceed 90\ndays.\n\n(c) For persons\nalready receiving services who experience significant life changes, such as a\nsignificant change in their medical conditions, the period of\ntime for initiation of new services shall not exceed 90 days from the\namendment of the individual service agreement except by mutual agreement\nbetween the area agency and the person specifying a time limited extension.\n\n(d) Notwithstanding subparagraphs I(a)-(c) of\nthis section, for fiscal years 2008 and 2009, the timelines set forth in each such\nsubparagraph may be exceeded, provided that best efforts shall be made to meet\nthe timelines for children graduating or exiting school and for other\nindividuals the department determines most in need and to minimize delays with\nrespect to others within the limits of available funding and to provide them\ninterim services when the timelines have been exceeded by 60 days for fiscal year\n2008 and 30 days for fiscal year 2009.\n\nII.\nBeginning with the fiscal year ending June 30, 2010, and thereafter, the\ndepartment of health and human services shall incorporate the cost of fully\nfunding services to eligible persons, in accordance with the requirements of paragraph\nI, and as otherwise required under RSA 171-A, and the legislature shall\nappropriate sufficient funds to meet such costs and requirements.\n\n363:3 New Section; Improvements in Capacity\nof Service Delivery System. Amend RSA\n171-A by inserting after section 1-c the following new sections:\n\n171-A:1- d Improvements in\nCapacity of Service Delivery System.\n\nI. To ensure that the service delivery system\nhas the capability of recruiting and retaining a sufficient\nnumber of qualified personnel at all levels and to address related\nissues, the following shall occur:\n\n(a) The average salary\nof direct support staff employed by area agencies or providers with which area\nagencies contract shall increase by at least 2 percent beginning on July 1, 2007\nand at least 2 percent on January\n1, 2009.\n\n(b) The reimbursement\nrate for enhanced family care providers shall increase by at least 2 percent\nbeginning on July 1, 2008.\n\nII.( a) Within 30 days of\nthe effective date of this section, the department shall convene a committee\nwhich shall develop a plan to address long-term workforce and related human\nresources issues. The members of the\ncommittee shall be:\n\n(1) Two representatives\nfrom the department, appointed by the commissioner.\n\n(2) A representative of\nthe New Hampshire Developmental Disabilities Council, appointed by the council.\n\n(3) A representative of\nthe Institute on Disability, university\nof New Hampshire,\nappointed by the institute.\n\n(4) A representative of\nthe Disabilities Rights Center,\nappointed by the center.\n\n(5) A representative of\nthe Community Support Network, appointed by the network.\n\n(6) A representative of\nthe New Hampshire Brain Injury Association, appointed by the association.\n\n(7) A representative of\na private provider network, appointed by the commissioner.\n\n(8) A representative of\nPeople First of New Hampshire, appointed by such organization.\n\n(9) Three\nrepresentatives of local family support councils, appointed by the state Family\nSupport Council.\n\n(10) Three\nrepresentatives of area agency boards of directors, appointed by the Community\nSupport Network.\n\n(b) The plan shall at a minimum:\n\n(1) Provide for annual\nor periodic salary increases and recommendations for salary differentials or\nincrements based on amount of experience or other factors for all staff\npositions at the area agency and provider level, in addition to the salary\nincreases for direct support staff positions required by subparagraph\nI(a). With respect to direct support\nstaff, the plan shall provide for a method to increase their salaries so that\nthey are at least at parity with the mental health worker I position at New Hampshire hospital\nby July 1, 2011,\nand remain so thereafter.\n\n(2) Provide for increased enhanced family\ncare rates and rate structure, in addition to the rate increase specified in\nsubparagraph I(b).\n\n(3) Address whether and how free college tuition\nprograms should be made available or increased to help attract and retain a\nqualified workforce.\n\n(4) Address whether and\nhow affordable health insurance should be made available to workers employed at\nthe area agency or provider level as well as to enhanced family care providers.\n\n(c) The department\nshall submit the plan to the oversight committee established in\nRSA 171-A:1-c, by December\n1, 2007. Any members of the committee may submit additional or dissenting\ncomments and recommendations to the committee by December 15, 2007.\n\nIII.( a) By November 1,\n2008, the committee appointed in paragraph II shall develop a quality assurance\nand enhancement plan by building on, modifying, and improving upon the\nNew Hampshire quality outcomes partnership process providing for:\n\n(1) Rigorous, and where\npossible, measurable standards of performance expected of area agencies and\nproviders in accordance with the purposes and requirements of RSA 171-A.\n\n(2) Multiple procedures\nand processes in accordance with professionally recognized program evaluation\nand quality assurance standards to render determinations as to whether such\nstandards of performance are being met.\n\n(3) Examination of the\neffects of an area agency as sole provider on service delivery.\n\n(4) Identification of the type and number of\nemployed or contracted staff at the department and area agency level necessary\nto initiate and then carry out activities in subparagraph II(b), and if new\nstaff are needed, whether they can be added through redeployment,\nreorganization, use of federal funding, information technology enhancements, or\nother initiatives without impairing other department responsibilities, and if\nnot, the amount of new funding that will be needed.\n\n(5) Where such quality\nassurance and enhancement system capacity shall be located and report to in order to ensure maximum independence and effectiveness.\n\n(b) The department\nshall submit the plan to the oversight committee, established in\nRSA 171-A:1-c, by November\n1, 2008. Any members of the\ncommittee may submit additional or dissenting comments and recommendations to\nthe committee by November\n15, 2008. The committee may\nchoose to consult with an independent, nationally recognized organization in\nprogram evaluation and quality assurance to evaluate and report on the\neffectiveness of the quality assurance and enhancement system.\n\nIV. The plans required by paragraphs II\nand III shall include a breakdown of all costs of implementation of and\noperation for each component and any recommendations for legislation or rules\nchanges. The oversight committee\nestablished in RSA 171-A:1- c, shall review the plans,\nprovide feedback to the department, and submit any proposals for legislation it\ndeems necessary. Nothing in this section\nshall be construed to preclude the department from\nengaging in rulemaking or taking other initiatives within its authority to\nimplement the components of the plan.\n\n363:4 New Paragraph; Definition Added. Amend RSA 171-A:2 by inserting after\nparagraph I-c the following new paragraph:\n\nI-d.\n\u201cAssistive technology\u201d means assistive technology as defined by 29\nU.S.C. section 3002(3).\n\n363:5 New Paragraph; Definition Added. Amend RSA 171-A:2 by inserting after\nparagraph V the following new paragraph:\n\nV-a.\n\u201cDirect support\nstaff\u201d means any person employed by an area agency or contract provider in\nwhich at least 50 percent of the person\u2019s time is providing direct care or\nsupport to a client.\n\n363:6 Entry Into\nService Delivery System. Amend RSA\n171-A:6, II to read as follows:\n\nII. A comprehensive screening evaluation,\ncoordinated by the staff of the area agency, shall determine the scope of the\nperson\u2019s disability and the locus and nature of services to be provided and\nshall include an assistive technology evaluation both as part of the person\u2019s\ninitial evaluation and at least on an annual basis thereafter when the person\nis screened for an assistive technology evaluation. The commissioner shall adopt rules pursuant\nto RSA 541-A relative to the evaluation.\nThe initial evaluation shall include, but not be limited to, a physical\nexamination and individual intellectual assessment and functional behavior\nscales and shall take into account the provisions of\nand services established under RSA 186-A.\n\n363:7 Oversight Committee. Amend RSA 171-A:1-c to read as follows:\n\n171-A:1- c Oversight\nCommittee; Establishment.\n\nI. There shall be an oversight committee to\nreview the allocation of funds to persons with [ severe] developmental\ndisabilities [ classified as priority A or B consisting]\nor\nacquired brain disorders and to assure that eligible persons\nreceive services in a timely manner and in accordance with their needs. Such committee shall consist of 6\nmembers as follows:\n\n(a) Three members of the house of\nrepresentatives, one of whom shall be a member of the house health, human\nservices and elderly affairs committee, appointed by the speaker of the house.\n\n(b) Three members of the senate, appointed by the\npresident of the senate.\n\nII. Membership on the\noversight committee shall be for the biennium and shall be coterminous with\nmembership in the general court.\n\nIII. The oversight\ncommittee shall have a chairperson who shall be chosen by vote from among the\ncommittee membership. The chairperson\u2019s\nterm of office shall be for the biennium.\nThe committee shall have a clerk who shall be chosen by vote by members\nof the committee. The clerk\u2019s term of\noffice shall be for the biennium. The\nlegislative members of the committee shall receive legislative mileage when in\nperformance of their duties.\n\nIV. The committee\u2019s\nduties shall include, but not be limited to:\n\n(a) Reviewing the\nallocation of funds to persons with [ severe] developmental disabilities\n[ classified as priority A or B] and acquired brain disorders and to monitor\nwhether such eligible persons are having funding allocated and receiving those\nservices in accordance with the timelines set forth in RSA 171-A:1-a, II.\n\n(b) Monitoring whether\nsuch eligible persons are experiencing undue delays in the other parts of the\nservice development and implementation process from the time of application to\nthe eligibility determination and from allocation of funds to service\nimplementation.\n\n(c) Monitoring systems\nimprovements and safeguards at the department and area agency levels designed\nto ensure service quality and options.\n\n[ (b)]\n(d) Making recommendations\nto the commissioner.\n\n[ (c)]\n( e) Submitting quarterly\nreports, together with any recommendations for legislation, to the speaker of\nthe house of representatives, the senate president, and the governor. Each report shall address the items\ndescribed under subparagraphs IV(a) and (b), and semi-annually the report shall\naddress the items in subparagraph IV(c).\n\nV.\nThe department shall make quarterly reports to the oversight committee\non the status of subparagraphs IV(a) and (b) in a form prescribed by the\ncommittee.
