It included a 10 cent tobacco tax increase to pay for the thenassumed cost. The prime sponsor also supported a nursing home bed tax as an alternative revenue source, and similar taxes on home health care and some intermediate care beds open to Medicaid clients were considered. Without knowing at what level the nursing home and other Medicaid provider payments will be funded by the Finance Committee, or how they will restructure the policy part of the bill, the Ways & Means Committee is incapable of evaluating whether these revenue options are appropriate. The Committee therefore stripped the revenue source from the bill and sends it forward without recommendation on the policy aspects to be dealt with by the Finance Committee, which has agreed to consult with Ways & Means when they return to the question of revenue."}], "source": "House Calendar 19, 2003", "date": "2003-03-07", "dated": "printed", "cite": "HC 19", "cite_url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=calendars%5C2003%5CNo%2019%20March%207%202003.pdf"}, {"bill": "HB663", "title": "relative to county and state funding of long-term care medicaid programs", "majority_recommendation": "OUGHT TO PASS WITH AMENDMENT", "minority_recommendation": null, "reports": [{"side": "Committee", "author": "Rep. It covers nursing home, residential and home and community-based care. The bill establishes a county-state finance commission to oversee the relationship and make recommendations on rate setting, billing systems and individual county payment limits. The bill continues the limit on nursing home beds and caps the counties' financial liabilities for long-term care for FY 04 and FY 05 at $58 million and $60 million respectively. The bill establishes a nursing home assessment at 6% of gross revenues that will be matched with federal funds. The result is an additional $23 million that will be distributed through a quality incentive program to nursing homes that serve Medicaid patients. The counties will receive approximately $12 million of those funds, which would have a very favorable impact on county property taxes. No nursing home will suffer financially as a result of the assessment, regardless of whether it serves Medicaid or private pay residents. The bill also establishes similar assessments on community mental health center providers and provides for the developmentally disabled."}], "source": "House Calendar 31, 2003", "date": "2003-04-04", "dated": "printed", "cite": "HC 31", "cite_url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=calendars%5C2003%5CNo%2031%20April%204%202003.pdf"}], "docket_reports": [{"date": "2003-05-09", "dated": "recorded", "body": "S", "committee": "Public Institutions, Health and Human Services", "side": "", "recommendation": "OUGHT TO PASS", "vote_yeas": null, "vote_nays": null, "amendment": "", "new_title": false, "cite": "SC 22", "cite_url": "https://gc.nh.gov/senate/calendars_journals/viewer.aspx?fileName=Calendars%5C2003%5CSC%2022.pdf"}, {"date": "2003-06-03", "dated": "recorded", "body": "S", "committee": "Finance", "side": "", "recommendation": "OUGHT TO PASS WITH AMENDMENT", "vote_yeas": null, "vote_nays": null, "amendment": "1977", "new_title": false, "cite": "SC 25A", "cite_url": "https://gc.nh.gov/senate/calendars_journals/viewer.aspx?fileName=Calendars%5C2003%5CSC%2025A.pdf"}], "report_actions": [], "veto_message": null, "bill_note": null, "subject": "Miscellaneous", "subject_source": "granite record", "house_committee": "Ways and Means", "senate_committee": "Public Institutions, Health and Human Services", "lsr": "2003-586", "docket_url": "https://gc.nh.gov/bill_status/legacy/bs2016/bill_docket.aspx?lsr=586&sy=2003&txtsessionyear=2003&txtbillnumber=hb663&sortoption=billnumber", "documents": [{"label": "Bill status page", "url": "https://gc.nh.gov/bill_status/legacy/bs2016/Bill_status.aspx?lsr=586&sy=2003&txtsessionyear=2003&txtbillnumber=hb663&sortoption=billnumber", "kind": "status"}, {"label": "Docket", "url": "https://gc.nh.gov/bill_status/legacy/bs2016/bill_docket.aspx?lsr=586&sy=2003&txtsessionyear=2003&txtbillnumber=hb663&sortoption=billnumber", "kind": "docket"}, {"label": "HC 20", "url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=calendars%5C2003%5CNo%2020%20March%207%202003.pdf", "kind": "record"}, {"label": "HC 31", "url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=calendars%5C2003%5CNo%2031%20April%204%202003.pdf", "kind": "record"}, {"label": "SC 20", "url": "https://gc.nh.gov/senate/calendars_journals/viewer.aspx?fileName=Calendars%5C2003%5CSC%2020.pdf", "kind": "record"}, {"label": "SC 22", "url": "https://gc.nh.gov/senate/calendars_journals/viewer.aspx?fileName=Calendars%5C2003%5CSC%2022.pdf", "kind": "record"}, {"label": "SC 25A", "url": "https://gc.nh.gov/senate/calendars_journals/viewer.aspx?fileName=Calendars%5C2003%5CSC%2025A.pdf", "kind": "record"}, {"label": "House Calendar 19, 2003, committee report", "url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=calendars%5C2003%5CNo%2019%20March%207%202003.pdf", "kind": "report"}], "amendments": [{"num": "1977", "kind": "Committee Amendment", "where": "committee", "date": "2003-06-05", "body": "S", "adopted": true, "vote_kind": "VV", "mover": "", "proposed_by": "", "text": "", "source": "", "targets": [], "supersedes": []}, {"num": "2277", "kind": "Enrolled Bill Amendment", "where": "enrolment", "date": "2003-06-24", "body": "S", "adopted": true, "vote_kind": "VV", "mover": "", "proposed_by": "", "text": "", "source": "", "targets": [], "supersedes": []}], "billtext": {"version": "Final version", "title": "", "analysis": "This bill:\n\nI. The department shall not increase expenditures in approved budgets for care class lines or the number of persons to receive mid-level or home care services without the approval of the legislative fiscal committee, and the prior review of the county-state finance commission.\n\nII. For the fiscal year beginning July 1, 1999, and each fiscal year thereafter the average annual cost for the provision of services to persons in the mid-level of care shall not exceed 50 percent of the average annual cost for the provision of services in a nursing facility. The average annual cost for the provision of services in home-based care shall not exceed 33 percent of the average annual cost for the provision of services to persons in a nursing facility. Average annual costs shall be the net medicaid costs exclusive of provider payments. The department shall provide a report semi-annually on the utilization of non-nursing home services to the county-state finance commission and the legislative fiscal committee.\n\n223:6 Payment of Funds for Persons Eligible to Receive Nursing Home Care. The counties shall have an aggregate credit of $2,000,000 against amounts due under this section for each fiscal year beginning July 1, 1998. The $2,000,000 shall be allocated among the counties based upon the proportion each paid under this section in the prior fiscal year and shall be made available as soon as possible after the start of the fiscal year. If the federal share of expenditures under this section is made available to the state in a method other than as a fixed percentage reimbursement, the non-federal share shall be the amount of expenditures remaining after appropriate application of federal funds. The credit under this paragraph shall reduce the obligation of the counties under paragraph IV.\n\nIV. The total [ reimbursements] billings by all counties made pursuant to this section for persons who have been determined eligible to receive nursing facility services shall not exceed [ the amounts set forth below for any of the state fiscal years 1999-2003] 50 percent of the non-federal share of the combined long-term care medicaid spending for which the counties are obligated and in no instance shall the billings for the 12-month period of the state fiscal year, dated between July 1, 2004 and June 30, 2005 exceed:\n\n(a) State fiscal year [ 1999] 2004 -[ $54,000,000] $60,000,000.\n\n(b) State fiscal year [ 2000] 2005 -[ $57,000,000] $64,000,000.\n\n[ (c) State fiscal year 2001--$60,000,000.\n\n(d) State fiscal year 2002--$63,000,000.\n\n(e) State fiscal year 2003--$66,000,000.]\n\nV. Amend RSA by inserting after chapter 84-B the following new chapter:\n\nCHAPTER 84-C\n\nNURSING FACILITY QUALITY ASSESSMENT\n\n84-C:1 Definitions. In this chapter:\n\nI. \"Assessment\" means the nursing facility quality assessment imposed pursuant to this chapter.\n\nII. \"Assessment period\" means a 3-month period beginning July 1, October 1, January 1, and April 1, of each year.\n\nIII. \"Commissioner\" means the commissioner of the department of revenue administration.\n\nIV. \"Net revenues\" means revenues earned on an accrual basis of accounting, net of deducted amounts for bad debts, charity care, and payer discounts, by a nursing facility for services provided to residents as provided for in 42 CFR 433.68(d)(1)(iii).\n\nV. \"Nursing facility\" means a nursing facility as defined in RSA 151-E:2, V.\n\n84-C:2 Imposition of Fee. An assessment of up to 6 percent of aggregated net revenues is hereby imposed on all nursing facilities on the basis of non-medicare patient days. The fee shall be implemented in accordance with the provisions of 42 C.F.R. part 433.\n\n84-C-3 Assessment Due.\n\nI. Each nursing facility shall pay 100 percent of its nursing facility quality assessment due and payable for the assessment period no later than the fifteenth day of the month following the assessment period. Notwithstanding any provision of law to the contrary, no penalty or interest shall be imposed for failure to make payment of the assessment when due if such payment is made on or before the last day of the month in which such payment is due.\n\nII. If the return required by RSA 84-C:4 shows an additional amount of assessment to be due, such additional amount is due and payable at the time the return is due.\n\n84-C:4 Returns. Every nursing facility shall on or before the tenth day of the month following the expiration of the assessment period make a return to the commissioner and to the commissioner of the department of health and human services. The commissioner shall adopt rules, pursuant to RSA 541-A, relative to the form of such return and the date which it must contain for the correct computation of facility net revenues and the assessment upon such amount. All returns shall be signed by the authorized representative of the nursing facility, subject to the pains and penalties of perjury. If such return shows an overpayment of the assessment due, the commissioner shall refund or credit the overpayment to the nursing facility.\n\n84-C:5 Collection and Deposit of Assessment.\n\nI. The payments required by RSA 84-C:3 shall be made by electronic transfer of moneys to the state treasurer and deposited to the nursing facility trust fund established by RSA 151-E:14.\n\nII. The state treasurer is authorized to establish an account or accounts and to take all steps necessary to facilitate the transfer of moneys required in paragraph I.\n\n84-C:6 Additional Returns. When the commissioner has reason to believe that a nursing facility has failed to file a return or to include any part of its net revenue in a filed return, the commissioner may require the nursing facility to file a return or a supplementary return showing such additional information as the commissioner prescribes. Upon the receipt of the supplementary return, or if none is received within the time set by the commissioner, the commissioner may find and assess the amount due upon the information that is available. The making of such additional return does not relieve the nursing facility of any penalty for failure to make a correct original return or relieve it from liability for interest imposed under RSA 21-J:28 or any other additional charges imposed by the commissioner. This section shall not be construed to modify the statute of limitations provided in RSA 21-J:29.\n\n84-C:7 Extension of Time for Returns. For good cause, the commissioner may extend the time within which a nursing facility is required to file a return, and if such return is filed during the period of extension no penalty or late filing charge may be imposed for failure to file the return at the time required by this chapter, but the nursing facility shall be liable for interest and late payment charges as prescribed in RSA 21-J:28 or RSA 21-J:33. Failure to file the return during the period of the extension shall void the extension.\n\n84-C:8 Records.\n\nI. Every nursing facility shall:\n\n(a) Keep such records as may be necessary to determine the amount of its liability under this chapter.\n\n(b) Preserve such records for the period of 3 years or until any litigation or prosecution hereunder is finally determined.\n\n(c) Make such records available for inspection by the commissioner or his authorized agents, upon demand, at reasonable times during regular business hours.\n\nII. Whoever violates the provisions of this section shall be subject to the penalties imposed under RSA 21-J:39.\n\n84-C:9 Administration.\n\nI. The commissioner shall adopt rules, pursuant to RSA 541-A, relative to:\n\n(a) The administration of the nursing facility quality assessment; and\n\n(b) The recovery of any assessment, interest on assessment, or penalties imposed by this chapter or by RSA 21-J.\n\nII. The commissioner may institute actions in the name of the state to recover any assessment, interest on assessment, additions to assessment, or penalties imposed by this chapter or by RSA 21-J.\n\nIII. In the collection of any overdue tax, penalties or interest imposed by this chapter or by RSA 21-J, the commissioner may use all of the powers granted to tax collectors under RSA 21-J and RSA 80 for the collection of taxes.\n\n84-C:10 Confidentiality of Records. Notwithstanding the provisions of RSA 21-J:14, the commissioner shall not be prohibited from providing information to the commissioner of health and human services with respect to the assessment imposed by this chapter, provided that the commissioner of health and human services and his agents and employees shall be subject to the provisions of RSA 21-J:14 with respect to any information provided by the commissioner.\n\n84-C:11 Contingencies.\n\nI. The nursing facility quality assessment imposed by this chapter shall not be assessed, and no return shall be required to be made, upon the occurrence of any of the following events:\n\n(a) Aggregate medicaid reimbursement for nursing facilities through PAU 05-01-10-04-01 class 90 is reduced below the level in effect as of February 1, 2003.\n\n(b) Federal approval of the nursing facility quality assessment established under this chapter, or of any related state plan amendments or waivers is withdrawn.\n\n(c) Collection of the assessment is rendered invalid by the decision of any court or administrative agency.\n\n(d) Any proceeds from the nursing facility quality assessment established in this chapter are expended by the state or any state agency for any purpose other than funding nursing facility expenditures through the medicaid quality incentive program under RSA 151-E:13.\n\n(e) A state plan uniformity waiver as provided for in 42 C.F.R. section 433.68(e)(2) does not receive federal approval.\n\nII. The commissioner of health and human services shall notify the commissioner of revenue administration of the occurrence of any of the contingencies in paragraph I.\n\nIII. The nursing facility quality assessment under this chapter shall not be assessed or collected and the medicaid quality incentive program authorized by RSA 151-E:13 shall not be paid until after the commissioner of health and human services certifies to the commissioner that the department of health and human services has obtained federal approval of the assessment in RSA 84-C:2, the state plan uniformity waiver in RSA 84-C:11, I(e), the medicaid quality incentive program in RSA 151-E:13, and payments have commenced under the medicaid quality incentive program. Such payments under the medicaid quality incentive program shall commence 45 days after such certification and shall be effective for the period beginning May 1, 2003 or the effective date of the federal authorization for the nursing facility quality assessment, the uniformity waiver, and the medicaid quality incentive program, whichever is later.\n\n223:10 Long Term Care; Financial Eligibility Standards. The department shall implement a medicaid quality incentive program to assist all non-state owned nursing facilities with expenditures for medicaid residents to maintain and enhance their quality of care. The funds available to support this program shall be from the nursing facility trust fund established in RSA 151-E:14.\n\nII.(a) For governmental facilities, the medicaid quality incentive paid to a facility shall be based on the percentage of the facility's medicaid bed days to the facility's total bed days, weighted by the facility's medicaid bed days. The resultant bed days as a percentage of all facility medicaid bed days weighted in this same fashion for all facilities is the basis of allocation. The total amount to be allocated among the non-governmental facilities shall be determined by the allocation method for governmental facilities described in this paragraph. These amounts shall be totaled for all the non-governmental facilities and shall then be allocated among the non-governmental facilities as described in subparagraph (b).\n\n(b) For non-governmental facilities, the medicaid quality incentive payment shall be based upon the facility's medicaid bed days as a percentage of all medicaid bed days in non-governmental facilities.\n\n(c) Notwithstanding RSA 151-E:13, II(a) or (b), if the obtaining of federal approval of the assessment or the maintaining of the ongoing validity of the medicaid quality incentive program can be effectuated only by such action, the fiscal committee of the general court is authorized to establish that the medicaid quality incentive payment to both governmental and non-governmental facilities shall be done according to the following formula, and such payments shall thereafter be made in accordance with this formula: the medicaid quality incentive paid to a facility shall be based on the percentage of the facility's medicaid bed days to the facility's total bed days, weighted by the facility's medicaid bed days. The resultant bed days as a percentage of all facility medicaid bed days weighted in this same fashion for all facilities is the basis of allocation.\n\nIII. Within 15 days after the close of each quarter the commissioner of administrative services shall certify to the governor and the commissioner of health and human services the amount available to support the medicaid quality incentive program. The amounts certified are hereby appropriated to the department of health and human services for the purpose of implementing the medicaid quality incentive program and the governor is authorized to draw warrants for said sums out of any money in the treasury not otherwise appropriated. The department of health and human services shall designate a specific budget class line for the medicaid quality incentive program.\n\nIV. When the funds for the medicaid quality incentive program are made available, the department of health and human services shall immediately distribute them to eligible facilities together with any matching federal funds that may be available to support the program. The medicaid quality incentive program funds shall be distributed no later than 30 days after the close of each quarter.\n\nV. Notwithstanding the obligation of the counties to fund services pursuant to RSA 167:18-b, the counties shall not contribute toward the cost of the medicaid quality incentive program.\n\n151-E:14 Nursing Facility Trust Fund Established. There is hereby established the nursing facility trust fund for the receipts from the nursing facility quality assessment under RSA 84-C:3, any federal financial participation received by the state as a result of expenditures funded by these nursing facility quality assessments, and the interest thereon. All of these funds shall be credited to and for the purposes of the nursing facility trust fund and shall not be used for any other purposes.\n\n151-E:15 Expenditure of Funds from Nursing Facility Trust Fund. The total amount of any penalty shall not, however, exceed 25 percent of the amount of the tax due or $50, whichever is greater. This penalty shall not be applied in any case in which a return is filed within the extended filing period as provided in RSA 77:18-b, RSA 77-A:9, RSA 77-E:8, RSA 83-C:6, RSA 83-E:5 [ or], RSA 84-A:7, or RSA 84-C:7, or the failure to file was due to reasonable cause and not willful neglect of the taxpayer.
