Committee — INEXPEDIENT TO LEGISLATE
The committee does not believe this resolution is needed at this time. This resolution is unconstitutional because it would signal that the legislature does not have the ability to determine municipal planning and zoning. New Hampshire is a “Dillon’s rule state” meaning that local governments may only exercise powers that were specifically granted to them by the state. In 1925, the New Hampshire government passed the Zoning Enabling Act (ZEA) which enables municipalities to control planning and zoning. The 1925 ZEA however, did not grant unlimited power to zone, in fact, it maintained a narrowly tailored list of reasons to zone and plan. The ZEA permitted local governments to zone for “health, safety, or general welfare of the population.” This bill does not have a narrow scope, it argues that local communities have the unlimited power to zone and control their communities. These rights could include local mandates for Sharia Law in certain zones and local bans of known constitutional rights including the right to marry and the right to bear arms. That has and never should be the NH way. The State of New Hampshire and its political subdivisions have always done things working hand-in-hand and a number of bills passed by the Housing Committee address situations in which a local governments may have overstepped. This collaborative approach has and should always remain how we do things in Concord. If the resolution said something along these lines: “planning, zoning, and related regulations have been and should be a collaborative effort between the state and local communities” the Housing Committee recommendation may have been different. For these reasons, we recommend this resolution be Inexpedient to Legislate. Vote 17-0.
