Committee — INEXPEDIENT TO LEGISLATE
This resolution would request an Opinion of the Justices from the Supreme Court clarifying the state’s obligations regarding education. Some members of the committee are weary of ever requesting an advisory opinion from the court because, unconstrained by the facts and reality of an actual case, there is an increased risk of faulty reasoning or other mischief in such cases. In any event, because this resolution does not pertain to any specific legislation, but merely requests the court, in essence, to write an essay on education funding, the court almost certainly would decline such a request. Vote 18-0.
