The concerns about campus carry ignore constitutional mandates, real-world data, and the urgent need for self-defense on public university campuses. This bill upholds New Hampshire’s second amendment heritage, empowering adults to protect themselves without endangering safety. There are claims that gun bans make campuses safer than surrounding areas, but this overlooks demographics and security measures as primary factors, not bans. The Department of Justice (DOJ) data shows 93% of student violent crimes occur off-campus, beyond these policies. States like Utah, Colorado, and Texas have allowed campus carry for years without violence spikes; a 2019 study confirms no link to increased crime. Gun-free zones, conversely, invite attacks on the defenseless, as mass shootings target them. On the second amendment, Heller and Bruen affirm self-defense rights at home and in public, demanding restrictions align with history. Adult-dominated universities differ from K-12 schools; courts in Texas and elsewhere uphold campus carry. Blanket bans infringe on these rights unjustly. Some allege campus carry heightens accidents, shootings, and suicides without reducing violence, yet evidence contradicts this. Minority — INEXPEDIENT TO LEGISLATE
The overwhelming majority of the 4,400 colleges and universities in the United States prohibit the carrying of firearms on their campuses. These policies have helped to make our post-secondary education institutions some of the safest places in the country, often experiencing crime rates significantly than those of surrounding communities. Proponents argue that campus carry bans violate the second amendment. While the 2008 Supreme Court ruling in District of Columbia v Heller established that citizens have the right under the second amendment to possess an ordinary type of weapon and use it for lawful, historically established situations such as self-defense in a home; the court also acknowledged the need for reasonable regulations to prohibit the carrying of firearms in “sensitive places,” such as schools and government buildings. In 2022, in NYSRPA v. Bruen, the Supreme Court clarified that the right to carry a firearm extends outside the home, but it also reaffirmed that firearms can still be restricted in certain places, including schools. There is simply no credible evidence to suggest that the presence of students carrying weapons, concealed or otherwise, would reduce violence or the risk of violence on our college campuses. However, there is a substantial risk that allowing firearms to be carried on campus would increase the risk of accidental discharges, intentional shootings, and the lethality of suicide attempts, while doing little or nothing to reduce violence or the risk of violence. New Hampshire state law clearly assigns the university system’s board of trustees with “the management and control of all property and affairs of the University of New Hampshire.” This responsibility includes the duty to maintain the safety of students, staff, and visitors in campus buildings, campus grounds, and campus venues, including Wildcat Stadium and the Whittemore Center. Should this bill be enacted, meeting this responsibility will become exponentially more difficult and more costly due to increased insurance costs and the need to provide enhanced security and hire and train additional security staff.
