Committee — OUGHT TO PASS WITH AMENDMENT
This bill eliminates a logical inconsistency in the requirements for recusal for a member of a land use board. Currently, if a board member feels that he meets the specific criteria for recusal, he/she must recuse. If other members of the board feel that the member should recuse, for instance due to a conflict of interest, the board currently takes a non-binding vote and the member may, or may not recuse. Under this bill, the vote would be binding. A committee amendment added due process to the original bill providing an opportunity for all parties to present supporting evidence in open session prior to a vote being taken. This bill sets forth a mandatory procedure under which land use board members are required to recuse themselves thus eliminating the possibility of an appeal based on conflict of interest which could cost the municipality many thousands of dollars in legal fees. Furthermore, it provides transparency for both applicants and board members. Vote 18-0.
