Committee — OUGHT TO PASS WITH AMENDMENT
This bill, with the replace all amendment, enhances the level of certain sexual assault related offenses involving minors to a felony by amending the introductory paragraph of RSA 632-A:2,I. Any person whom the defendant had or has a certain authority by virtue of their role in a correctional institution, the secure psychiatric unit, or a juvenile detention facility, or their role as an adult or juvenile probation officer. The court has ruled that a minor under the supervision of an authoritative figure in one of the aforementioned facilities is not able to “ submit”’ to sexual contact. By removing the words “and uses this authority to coerce the victim to submit” makes these heinous crimes a felony. Vote 13-0.
