Committee — REFER FOR INTERIM STUDY
Two words in this bill are the sticking point: “in perpetuity.” A carry forward in perpetuity is a very long time, and leaves the state on the hook, possibly forever, depending on a company’s losses. This issue has been looked at in the past and it was determined that allowing 10 years of net operating losses (NOL) has been reasonable. The Department of Revenue Administration estimates that the hit to revenues would be approximately $90 million per year. For those reasons, the committee voted to study this bill before making a final recommendation. It is possible that there is a different time period other than 10 years which makes more sense, but that will need to be researched and studied. Vote 19-0.
