Committee — INEXPEDIENT TO LEGISLATE
This bill would remove all references to gender identity from New Hampshire statutes, thereby eliminating existing protections and permitting discrimination on that basis under state law. As drafted, the bill would allow discrimination based on gender identity in employment; by members of the Police Standards and Training Council; within the state’s mental health services system; in family assistance programs; in public schools, including the removal of explicit anti-bullying protections; in loan applications and real estate transactions; and in places of public accommodation. These examples are illustrative and not exhaustive. The committee believes the bill would weaken core civil rights protections long embedded in New Hampshire law. It would create significant legal instability and expose the state to economic and reputational harm. In Title VII of the Civil Rights Act of 1964, as interpreted by the United States Supreme Court in Bostock v. Clayton County, discrimination in employment based on transgender status constitutes unlawful sex discrimination under federal law. Enactment of this bill would therefore create conflict and confusion between state and federal law, increasing compliance burdens and litigation costs for employers, businesses, school districts, and state government alike. For these reasons, the committee unanimously recommends Inexpedient to Legislate. Vote 14-0.
