Committee — OUGHT TO PASS WITH AMENDMENT

The committee believes this bill should be found Ought to Pass with Amendment. This bill with the underlying amendment would line up New Hampshire’s homeowners’ associations transparency language with the current condo association transparency language. Under this proposal, homeowners’ associations would be required to present upon request detailed minutes of meetings, receipts and expenditures made by the board, and institute conflict of interest requirements for board members as well as a number of other requirements in current condominium law. The amendment removes the enforcement mechanism in the bill in which the committee believes the fiscal note would be null. Additionally the amendment would move out the effective dating giving opportunities for homeowners’ associations to procure required documentation. Vote 18-0.
