Majority — INEXPEDIENT TO LEGISLATE
This bill establishes an unelected advisory commission to perform the constitutional responsibility of legislative redistricting. The committee found that the New Hampshire Constitution assigns this responsibility to the legislature, and that the bill would shift authority away from elected representatives and, under certain circumstances, to the judicial branch. The majority of the committee further noted that the bill creates a new standing commission with indeterminable long-term fiscal impacts without a demonstrated need to alter the existing redistricting process. For these reasons, the majority of the committee recommends the bill be found Inexpedient to Legislate. Vote 9-7.
Minority — OUGHT TO PASS
This bill establishes an advisory redistricting commission to assist the legislature in creating new districts every 10 years. It will achieve a fairer redistricting process than the one that we now have. It is designed so that the voters draw the lines, not legislators. The purpose of the commission is to make the redistricting process more transparent and impartial by establishing standards for commission members and criteria that must be followed when drawing maps. The NH Constitution gives the legislature the power to redistrict, but does not tell us how we must do it. We can create a new process that places some of the work in the commission without violating the constitution. This bill is modeled on the Colorado commission, which is considered the “gold standard” among the 20 states that have independent commissions. The 3 critical factors in the bill are: 1. The commissions are not evenly split between Democrats and Republicans – they have independent members not affiliated with either party. 2. Commissions should have binding authority to implement new district lines independent of state legislators. Otherwise, the legislators vote against the commission’s proposal and set up one that is politically driven. 3. Members of the commission should not be current elected officials, recently retired politicians, or political appointees. And, they should not be appointed by political officials. A late summer 2025 poll by NBC News of over 30,000 voters found that Americans’ support for nonpartisan redistricting is high even when their party would be in control of the process. The poll found that 82% of Americans prefer districts drawn by nonpartisan commissions rather than the party in power in each state. We may never be able to remove politics totally from redistricting, but we certainly owe it to our constituents and our constitutional democracy to try.
