RSA 260:32 assesses $0.18 cents per gallon sold for deposit into the state’s road toll fund. Not all fuel purchased by the consumer goes onto the road; most specifically, construction equipment. Currently, construction equipment owners and other non-road users have the ability to apply for a refund to recoup that portion of the road toll. Sometimes, these consumers apply late for their refund. Unfortunately, RSA 260:47 provides a late filing process for political subdivisions only. Private entities do not have a late filing process for them to pursue for their refund. With this bill, private entities would now be afforded the same process as political subdivisions to file late for their refund. The committee unanimously agreed with the testimony provided in support of this bill. Furthermore, the committee viewed the bill as pro-business, and believed that this change in the law would provide clarity and parity for our non-road users while streamlining the reimbursement process. Vote 14-0.
