Majority — OUGHT TO PASS WITH AMENDMENT
As introduced, this bill attempted a light approach to establishments which delivered an expected $600,000 per biennium cost. As amended, this bill provides the tools necessary for law enforcement to identify the people responsible for human trafficking and/or money laundering in facilities which appear to offer massage or bodywork but instead make their profits from exploiting vulnerable women. By defining a massage or bodywork establishment as an independent location with more than one professional working, this bill does not interfere with sole proprietors and allows massage therapy to continue within chiropractic offices, residential living facilities, and even popups in the grocery store. As amended, the bill will require the person or people responsible for operating a facility offering massage or bodywork services to be licensed in the practice and to obtain a proprietor license after providing their social security number or taxpayer ID number and passing a state police background check for sexual crimes, kidnapping, and human trafficking. Inspections will operate under the existing power of the office of professional licensing. By focusing on ensuring that all establishments are operated by identifiable individuals, this bill provides a cost-effective way to empower law enforcement to prosecute human traffickers and provides a tangible pathway to prevent people with convictions for sex crimes or interference with freedom from opening these facilities in our state at an expected cost in line with existing professional licensing fees. Vote 9-5.
Minority — REFER FOR INTERIM STUDY
The committee heard two bills related to massage establishment licensure with extreme similarities. The minority of the committee favors the other bill, but believes that the overlapping language and changes to the same statute could lead to problems if both pieces of legislation are passed. By going through interim study, we will have additional time to learn if the other bill is sufficient in addressing the issues raised during the hearings and it gives us time to reassess how to write language that better incorporates this bill into the language of the other bill. Both pieces of legislation are well intended and seek to solve the real problem of human trafficking, but we cannot let potentially overlapping language leave a gap.
