Majority — INEXPEDIENT TO LEGISLATE
This bill was recommended Inexpedient to Legislate due to the fact that the intent of the bill is already in existing law. The committee agreed that employees should be protected from the elements but for employers with over 15 employees, safety provisions are in place. Vote 12-8.
Minority — OUGHT TO PASS WITH AMENDMENT
This bill is a workplace extreme temperatures protection standards act 42 27 FEBRUARY 2026 HOUSE RECORD which establishes mandatory safety protocols for workers exposed to extreme heat and cold. The bill applies when the temperature heat index or wind chill reaches 80°F and above or 15°F and below. The amendment widens the temperature window to 90°F and above or 0° or below. To achieve these protections, employers must develop site-specific written safety plans, given paid rest breaks in temperature-protected areas and be given water breaks - hydration. Employers must have programs for all employees on identifying symptoms, personal risk factors, and emergency response. The bill authorizes the New Hampshire Commissioner of Labor to create rules for enforcement and protections.
