Committee — INEXPEDIENT TO LEGISLATE
The committee opposes this bill because it would declare that legal use of therapeutic cannabis under New Hampshire law does not disqualify a person from purchasing, owning, or possessing firearms, even though federal law makes it a felony for any “unlawful user of or addicted to any controlled substance” to possess firearms or ammunition. Marijuana remains a schedule I controlled substance under federal law, with no exception for stateapproved medical use. New Hampshire cannot override or nullify this federal prohibition, so the bill provides no real protection and instead lulls users into believing they can legally buy and keep guns when doing so remains a serious federal crime punishable by up to 10 years in prison, fines, and lifetime firearm disqualification. Passage of this bill would endanger New Hampshire citizens by encouraging therapeutic cannabis patients to complete federal background checks and purchase firearms, only to face federal felony prosecution if their cannabis use comes to light. Federal authorities, including the ATF and U.S. Attorneys, routinely enforce §922(g)(3) against statelegal medical marijuana users, as confirmed in ATF guidance and multiple prosecutions nationwide. A granite state resident who relies on this bill’s assurances could forfeit their Second Amendment rights forever upon a federal conviction, while facing asset forfeiture and employment barriers. The bill also undermines federal supremacy and risks provoking federal enforcement scrutiny on New Hampshire. States cannot license what federal law criminalizes, and similar statelevel attempts to protect medical cannabis users from federal firearms prohibitions have failed in court and drawn ATF warnings. Rather than misleading vulnerable citizens into felonious conduct, the legislature should inform them of the controlling federal reality and avoid creating a state statute that conflicts with national law and invites unnecessary legal challenges. Because this bill offers no practical benefit, fosters a dangerous illusion of state protection against federal law, and exposes New Hampshire therapeutic cannabis users to felony risks and permanent rights loss, the majority finds this bill to be misguided and injurious to the citizens it purports to help. Vote 12-0.
