Committee — INEXPEDIENT TO LEGISLATE
This bill seeks to prevent municipalities, counties and school districts from issuing bonds to finance critical infrastructure except in certain situations designated as emergencies. The bill’s sponsor proposed that a system of capital reserve accounts, funded by special assessments, be used instead of bonds. Aside from the economic impact such a system would impose on residents, given the years it would take to establish such capital reserves, no credible system was proposed that would provide public bodies with rules or guidelines on how to establish and maintain such systems. Contrary to what this bill suggests, bonding is an effective mechanism for managing inflation, since necessary infrastructure can be built as soon as the bond is issued, preventing the inevitable delay of establishing large capital reserves while the costs of building continue to increase. Counties, municipalities and school districts have statutory responsibilities to maintain essential services. Such services include prisons, nursing homes, courthouses, school buildings, fire department infrastructure, technology systems and a host of other facilities residents depend upon. The bill would prevent them from fulfilling these responsibilities, while at the same time, imposing unnecessary delays and unanticipated levies of “special assessments” to fund the bill’s proposed capital reserves. Under RSA 33, the Municipal Finance Act, key regulations are set forth at the state level governing the issuance, terms, procedures and debt limits of municipal bonds. The hurdle for public endorsement of bonding is also high, requiring a 2/3 vote of the legislative body. This bill makes assertions that are not supported by facts, proposes a fiscal system that is unworkable, and all but guarantees that political subdivisions would be in violation of their legal obligations to provide services to residents. Vote 13-5.
