Majority — OUGHT TO PASS WITH AMENDMENT
As amended, the bill legislates that any vehicle who’s manufactured model year is older than 20 years is exempt from the need to title a motor vehicle upon purchase or transfer. This restores the rolling title exemption as it was prior to 2018 but sets it at 20 years as opposed to 15 years. Further, any vehicle over 20 years old which falls into an exempt status may electively be titled by the owner provided that they submit the proper documentation to establish chain of custody and ownership at the point when a title application is submitted. The majority of the committee believes that this will meet the standard to prevent fraud with the vehicles that are most ‘at risk’ while alleviating the time, expense, and difficulty of re-titling older vehicles. Additionally, if a person believes that they get more benefit from maintaining a title, this amendment allows for them to electively apply for a title despite exempt status. Vote 10-5.
Minority — INEXPEDIENT TO LEGISLATE
Issuance of titles is a valuable service provided by the state, to help ensure chain of ownership of vehicles, and delivered at reasonable price. While this bill, as amended, strikes a reasonable compromise on when titles are required, the minority feels that requiring titles for all passenger vehicles is the appropriate policy for the state.
