Committee — INEXPEDIENT TO LEGISLATE
This bill seeks to provide a petition mechanism for citizens to require their local school board to conduct a forensic audit when there is a deficit in the district’s budget. During the hearing, the testimony was directed at one particular school district, yet this bill would institute the petition requirement for school districts statewide. The bill also introduces a new petition threshold of one percent of the registered voters within a school district, when RSA 39:3 clearly states that such petitions require a two percent threshold. Therefore, if passed, the bill would immediately be in conflict with existing law. In addition, a forensic audit is time-intensive, extremely costly, and specifically defined as an effort to uncover fraud, bribery and embezzlement. Forensic audits frequently call for expert witnesses, result in legal challenges, and require other costly procedures that would be shouldered entirely by local taxpayers. In addition, the bill calls for the proposed forensic audit to be completed in 90 days when forensic audits routinely require several weeks to several months to complete. For these reasons, the committee recommendation is Inexpedient to Legislate. Vote 17-0.
