The committee believes this bill is not needed at this time. This bill as proposed would rewrite the application fee language that was carefully compromised and implemented last year. This bill would expand the application fee language into RSA 356-C:12 which is the prohibition section of the RSA. Under current law in RSA 540 there is language that allows the housing provider to collect an application fee but if they choose not to rent the unit to the applicant they must return the fee beyond the actual cost of conducting a background check, credit check, and reasonable administrative costs from vetting the tenant. The committee does not believe these changes need to be made at this time. Vote 16-2.
