Committee — OUGHT TO PASS
This bill makes a small change related to the return of search warrants. When a search warrant is executed, law enforcement is responsible for making an inventory of all seized property to submit to the court when the warrant is returned as executed. Such inventories must be witnessed by the property owner, the officer making the inventory and under current law, the person who acquired the warrant. This is often not practical. If the officer who acquired the warrant is involved in an arrest, is injured, or is otherwise unavailable to be at the location for the inventory, it can cause a logistical problem for the timely and proper execution of the warrant. This bill would change the current law and allow the officer making the search to conduct and record the inventory in the presence of the property owner and if the property owner is not present, any other officer may witness the inventory. The bill also eliminates the witness requirement for search warrants for electronic materials provided the officer receiving them attests to the accuracy. This may be phone records or internet activity obtained by warrant from a provider. This information is normally received electronically, making a witness impractical and unnecessary. Vote 13-0.
