Committee — INEXPEDIENT TO LEGISLATE
This bill proposes to allow low-impact homebased businesses by right. Home-based business was defined as any lawful business, profession, occupation, or trace conducted wholly or partly within a dwelling or its accessory structures by the occupants as a secondary use of the residence. Low impact was defined as having limited visibility, employees or customer visits, but remains residential in character. However, the committee was unclear if off-street parking permitted on the lot, a permitted sign not exceeding six square feet, and outdoor storage or display would support not changing the residential character. The committee supports the current ability of local zoning ordinances to remain under local control. Local zoning ordinance typically supports that incompatible uses should be separated. The committee believed there were concerns regarding homeowners associations and other local covenants that would be overwritten by this bill. Also, there were vague definitions for standards of noise and vibration that would be difficult to measure and enforce. Finally, local zoning ordinance typically allows for a resident to apply for a permit for a home-based business. For these reasons, the committee recommendation is Inexpedient to Legislate. Vote 17-0.
