Committee — OUGHT TO PASS WITH AMENDMENT
The committee has carefully reviewed this bill, relative to private roads and trails. The bill, as amended, clarifies that the use of a landowner’s private roads, ways, driveways, or trails shall not create rights by adverse possession or prescriptive use. The amendment narrows the application of the bill to ensure it does not affect utilities in use prior to January 1, 1948; existing state, county, or municipal prescriptive easements; or claims already fully adjudicated or currently being adjudicated before the effective date of 120 days after passage. The bill applies prospectively. After consideration and discussion, the committee voted unanimously to recommend Ought to Pass with Amendment. Vote 17-0.
