Majority — OUGHT TO PASS WITH AMENDMENT
This bill significantly strengthens the judicial performance evaluation process. It was crafted with input and consultation with the Judicial Branch. It adds new components to the evaluation of judges, including in-court observation and statistical analysis of case processing times. It also specifically includes both part time and full time judges, as well as senior judges and judicial referees. Most importantly, it provides that judicial evaluations of each judge shall be publicly available. The amendment provides that the commentary contained in evaluation questionnaires shall not be part of the published evaluations; this revision was made to accommodate the legitimate concerns of trial judges that such commentary often contains biased and/or slanderous comments by disgruntled litigants unhappy with the judge’s ruling in their case. Vote 9-7.
Minority — INEXPEDIENT TO LEGISLATE
The amended bill changes the process used to evaluate judges. Importantly, it requires that individual judicial performance evaluations be published. Under current law, the Supreme Court summarizes overall evaluations with actions taken to address inadequacies and deficiencies but without reference to specific judges. The minority does not believe that public release of individual evaluations will improve the administration of justice. Effective evaluation processes require constructive comments from knowledgeable colleagues and supervisors to improve performance through a feedback loop. It is unclear how publication of an evaluation provides informed, actionable steps a judge could use in practice. Additionally, the fiscal note attached to the bill calls for an additional expenditure from the General Fund of $160,000-$180,000 to create a new position in the judiciary and meet the bill’s other requirements. While the minority agrees that there is always room for improvement, it does not believe this bill gets us closer to that goal.
