This bill creates a new and unconstitutional barrier to candidacy, misapplies existing oathenforcement statutes, and threatens felony prosecution for information many granite staters cannot reasonably know or obtain. By requiring candidates to disclose foreign dual citizenship under RSA 641:1 and RSA 92:2, the bill effectively adds a qualification for office not authorized by Part I, Article 11 of the New Hampshire Constitution, while imposing criminal liability for uncertainty rather than intentional deception. Testimony highlighted that adoptees, naturalized citizens, and individuals with incomplete or inaccessible records would be disproportionately harmed, and no evidence was presented that undisclosed dual citizenship has ever posed a problem in New Hampshire elections. This bill risks stigmatizing foreign heritage, chilling participation in public life, and undermining the state’s longstanding commitment to open, accessible democracy without addressing any demonstrated need. For these reasons, the committee voted unanimously to find the bill Inexpedient to Legislate. Vote 15-0.
