This bill corrects a long-standing logical inconsistency in New Hampshire’s self-defense laws and upholds the constitutional right to bear arms. Currently, a law-abiding citizen in our state can legally carry a loaded firearm, the ultimate tool of lethal force, to protect themselves and their families. Yet, under current antiquated statutes, that same citizen can be charged with a crime for carrying a blackjack, brass knuckles, or a slungshot: tools that offer an intermediate, often less-lethal option for self-defense. The idea that we should ban certain objects because they are “designed to inflict injury” ignores the fundamental reality that self-defense sometimes requires the use of force against a violent aggressor. By repealing this prohibition for adults, this bill allows law-abiding citizens, particularly those who may be physically outmatched or who choose not to carry a firearm, to have access to effective means of protecting themselves. The bill responsibly maintains the prohibition for minors, ensuring these items stay out of the hands of children. Criminals, by definition, do not obey weapons bans; they will carry whatever they wish to a gang fight or a robbery. The current ban only serves to disarm the law-abiding victim. The majority believes in trusting the citizens of New Hampshire to choose the self-defense tools that best fit their needs, rather than relying on arbitrary government lists of banned objects. Minority — INEXPEDIENT TO LEGISLATE

At a time when violent crime is on the minds of many New Hampshire residents, this unnecessary and dangerous bill would put street fighting weapons that are now illegal to sell or possess into the hands of would-be aggressors on our streets and in our public gathering places. While the bill proposes a prohibition for minors, it proposes repeal of the current prohibition for everyone else. As a representative of the New Hampshire State Police testified, these weapons are clearly intended for no other purpose than to inflict the sort of bodily injuries that can turn a simple altercation into a fatality. Unlike a pipe or a screwdriver, which can have productive uses, this bill would legalize weapons that are intentionally designed to inflict brutal injuries on human beings. Use of these weapons can lead catastrophic injuries, including broken bones, severe wounds, and brain damage. Additionally, they are often associated with criminal activities, such as gang fights or robberies, and their very presence typically leads to more violent confrontations than would have occurred without them. This is not a self-defense bill. It is an attacker-enablement bill.
